The temporary restraining order released by the Regional Trial Court Branch 17 Judge Renato Fuentes on the aerial spray ban expires today. The TRO was released pending the decision on the constitutionality of the City Ordinance banning aerial spraying of pesticides in Davao City.
Months ago, the Davao City Council passed a landmark legislation banning the aerial spraying of pesticides over the city limits as filed by former Second District Councilor Nenita Orcullo. However, the Pilipino Banana Growers and Exporters Association (PBGEA) went to court questioning the constitutionality of the ordinance. This led Fuentes to release a TRO last June 20, 2007. The TRO had an effectivity of three months pending a final decision on the constitutionality of the ordinance.
Today, the TRO expires. With the expiration, the ordinance is now in effect. However, the court still has to validate the constitutionality of the ordinance. Although, today can be considered as a victorious day for environmentalists and Davao City residents, we cannot rest on our laurels yet.
The court must realize that the ordinance, although perceived to be harmful to the economy, is very must needed and beneficial for the welfare, not just of the city’s ecology, but more importantly, the city’s residents. The government exists, not to do business, but to protect the interests of its citizens and its jurisdiction.
